Employees are entitled to be properly compensated for the time they spend at work. This is commonly seen where individuals are compensated by the hour versus a salary. In many cases, employees are forced to work overtime, but are not properly paid OR paid at all for their extra time at work. When the issue of unpaid wages is brought up, employers warn or intimidate employees to avoid the topic. Other misconduct by employers includes:

• Failure to pay minimum wage as required by law;

• Failure to provide rest breaks and meal breaks as required by law;

• Improper paycheck deductions;

• Failure to pay wages due upon termination

The Fair Labor Standards Act (FLSA) provides a remedy for employees who have not been properly compensated for their overtime work by their employer. The FLSA establishes minimum wage, overtime pay, record-keeping, and youth employment standards affecting employees and provides penalties to those employers who refuse to adequately compensate their employees.
